The Speedway Control Bureau have examined the facts from a recent protest from the Scunthorpe team management and released the following statement based on their findings.

SCUNTHORPE v EDINBURGH: Sunday 17th July 2016

Scunthorpe lodged a Protest to the Meeting Referee at the above Meeting, that protested against the use of Mitchell Davey as an NL guest, in contravention of the Regulations.

Having examined all the facts, the SCB find that:

The BSPA instructed Edinburgh that as the Buxton v Belle Vue fixture was in the original Fixture List, and the above Meeting wasa re-arranged Meeting, having been postponed on June 12th, that Dan Bewley had to ride at Buxton and Edinburgh were therefore entitled to a Guest as per art 18.10 (d).

Clearly, Mitchell Davey was not being used as an NL guest, simply as a guest replacement under 18.10d. Mitchell Davey has a NL 6.00 MA, therefore fits the laid down criteria.

Furthermore, Edinburgh advised Scunthorpe by SMS at 15:14 on Friday 15th July (72 hours prior to the Meeting Start time) of the fact that Mitchell Davey would be the Guest rider replacing Dan Bewley.

On a number of points, the SCB rule that the Protest is not upheld.

- Under Art 3.9 (b) having been advised of the Edinburgh within the agreed timescales, a Protest must be lodged at least 24 hours before the Meeting Start Time.

- Under Art 3.8.1 (e) as the Referee ruled that Mitchell Davey was eligible to ride prior to the start of the Meeting. This is considered a Statement of fact and No Protest is permitted.

- Furthermore, Art 15.10, only permits the SCB to amend a Meeting Result under certain conditions: none of these apply in this case.

The Result of the Meeting: Scunthorpe 44, Edinburgh 45 therefore stands.
